When can you expect relief? As soon as your case is filed.
Once you file for either Chapter 7 or Chapter 13 Bankruptcy, an injunction known as the “automatic stay” goes into effect. This requires creditors to stop all collection actions, including lawsuits. What is the difference between Chapter 7 and Chapter 13 bankruptcy?
Chapter 7 is an immediate liquidation or discharge of all of a single debtor or married couples unsecured debt. A chapter 13 is a 3 or 5 year process (a “plan”) that ends with a discharge of any unsecured debt over and above what you are able to pay off during that timeframe. Oftentimes in a chapter 13, creditors end up getting paid only pennies on the dollar.

Can bankruptcy stop foreclosure or wage garnishment?
Absolutely. Filing bankruptcy triggers an “automatic stay” on any collection efforts (foreclosure, wage garnishment, vehicle or personal property repossession, lawsuits against you by a creditor). This automatic stay goes in place immediately. If you call us on the morning your home is scheduled for a foreclosure auction, we can typically avoid the foreclosure through filing your petition and sending the bank notice of the automatic stay. If a car or property is repossessed, we can typically look back one or two weeks to have your repossessed property returned to you upon an immediate filing of a voluntary petition.

How much does it cost to file bankruptcy?
For chapter 7, the court cost is $335. For chapter 13, the court cost is $310. Our fees range depending on complexity, but fall between $2,000.00 and $4,500.00 generally.
